Conditions of sale for online orders
These conditions apply to orders placed on chingolandia.com/pedir, for delivery or for pickup at the restaurant (Carrer de Floridablanca 108, 08015 Barcelona). By ticking the acceptance box and paying, you accept these conditions.
- Prices: in euros, VAT included. Pickup orders use the restaurant price; delivery orders use the published delivery price. You pay the price shown when you confirm the order.
- Delivery fee: calculated by the delivery service according to distance and shown before payment. Delivery is free on orders of €45 or more.
- Minimum delivery order: €20. Delivery area: up to 3 km from the restaurant.
- Payment: card only (Apple Pay and Google Pay included) through Stripe. We do not store your card details. The order goes to the kitchen once payment is confirmed.
- Opening times: orders are accepted within the hours shown on the page. Delivery and pickup times are estimates.
- Delivery: carried out by Uber Direct couriers hired by Chingolandia. You will receive a link to track your order.
- Pickup: give your name at the restaurant. Your order will be ready at the time you chose.
- Allergens: every dish lists its allergens. If you have a severe allergy, call us before ordering: all the listed allergens are handled in our kitchen.
Alcoholic drinks
We only sell alcohol to people aged 18 or over. By ordering alcohol you confirm you are 18 or older. The courier or our staff may ask for ID and not hand over the alcohol if you cannot show it; in that case we refund its price.
We do not accept orders with alcohol for delivery or pickup from 22:00.
Cancellations, refunds and complaints
- Right of withdrawal: as this is prepared, perishable food, the 14-day right of withdrawal does not apply (article 103.d of Spanish Royal Legislative Decree 1/2007).
- You can cancel free of charge by calling 611 83 15 70 before we start preparing your order. Once it is being prepared it can no longer be cancelled.
- If we cannot fulfil your order (for example, an item is unavailable, no courier is available or the address is outside the area), we will tell you and refund the full amount to the same card.
- If something is missing or wrong, email nader@mbco.es or call us within 24 hours, with a photo if possible. We will refund or replace the affected items.
- If an order cannot be delivered because the address is wrong or nobody is there to receive it, we cannot refund food that has already been prepared.
- Refunds go to the card used and usually take 5 to 10 business days to appear.
- Official complaint forms (hojas de reclamación) are available at the restaurant. You can also contact the Catalan Consumer Agency (consum.cat).
Privacy policy
Data controller: MIND BOOSTER S.L. (NIF B10967511), Calle Calabria 16, entresuelo, puerta 1, 08015 Barcelona. Privacy contact: nader@mbco.es.
- What we process: name, phone, email, delivery address, order notes, items ordered, amount and the boxes you tick (acceptance and age). We do not receive your full card details.
- Why: to prepare, charge and deliver your order, contact you about it, handle complaints and meet accounting and tax obligations. We will not send you advertising without your explicit consent.
- Legal basis: performance of the purchase contract (GDPR article 6.1.b) and compliance with legal obligations (GDPR article 6.1.c).
- Who else receives them, only what is needed: Stripe (payment), Uber (delivery: name, phone, address and notes), Last.app (till and kitchen tickets), Netlify (web hosting), n8n (order automation) and Microsoft (email). Some may process data outside the European Economic Area with the safeguards set by the GDPR, such as standard contractual clauses.
- How long: order data is kept for 6 years for accounting obligations (article 30 of the Spanish Commercial Code) and then deleted.
- Your rights: you can ask for access, rectification, erasure, objection, restriction and portability by emailing nader@mbco.es. If you believe we have not handled your data properly, you can complain to the Spanish Data Protection Agency (aepd.es).
Customer account and points
Creating an account is optional: you can order without one. If you create one, we keep your name, email, phone, language, the addresses you add, your birthday (if you give it), whether you want offers, your order history and your points movements. Your password is stored encrypted and nobody at Chingolandia can see it.
Why: to fill in your details when you order and to run the points programme. Legal basis: the points programme contract you accept when signing up (GDPR article 6.1.b). Offers by email only if you tick the box (GDPR article 6.1.a); you can withdraw it at any time in My account.
Points: 10 points per euro spent on food (after discounts; delivery does not count), 100 welcome points and double points in your birthday month. They are redeemed for the rewards on the order page, have no cash value, cannot be transferred and expire after 12 months without an order. They are deducted only when payment is confirmed. We may cancel points obtained through fraud.
Account data is hosted by Supabase on servers in the European Union (Frankfurt). When you log in, your browser keeps a session identifier in local storage, which is needed to keep you logged in. You can delete your account and data by writing to nader@mbco.es; order data that the law requires us to keep is kept for the required time.
Cookies and storage
This website uses no advertising or tracking cookies. The order page keeps your basket in your browser's local storage so it is not lost if you reload the page; this is technically necessary and you can clear it in your browser. Stripe may use its own technical cookies during payment to prevent fraud.
Governing law
These conditions are governed by Spanish law. If you are a consumer, the courts of your place of residence have jurisdiction. This text is available in several languages; in case of doubt the Spanish version prevails.
